Please read these Terms and Conditions carefully before using the website located at nacogdochesfence.com or engaging the services of TX Nacogdoches Fence ("Company," "we," "us," or "our"). By accessing this website or requesting services, you agree to be bound by these terms.
By using this website, submitting a contact or estimate request, or engaging our services, you confirm that you are at least 18 years of age and have the legal authority to enter into an agreement with TX Nacogdoches Fence. If you do not agree with any part of these terms, please do not use this website or request our services.
TX Nacogdoches Fence provides residential and commercial fence installation, repair, replacement, and related services in Nacogdoches, Texas and surrounding communities. The specific scope of work for each project is defined in a written estimate or contract provided to the customer before work begins. Services not listed in the written estimate are not included in the agreed price.
All estimates are provided in writing and are based on a site visit and the information available at the time of assessment. An estimate is valid for 30 days from the date it is issued unless otherwise noted in writing.
Estimates may be revised if site conditions differ materially from those observed during the estimate visit, if you request changes to the scope of work, or if material costs change significantly before work begins. Any revision will be communicated to you in writing before additional work is performed.
An estimate is not a guarantee of final cost unless it has been signed by both parties as a binding contract. We will make every effort to complete work at or below the estimated price.
Work is scheduled after a written estimate is accepted and any required deposit is received. Start dates are estimates and may shift due to weather, permitting delays, or prior job extensions. We will notify you as soon as reasonably possible if a scheduled date must change.
If you need to cancel or reschedule, please notify us at least 48 hours in advance. Cancellations made after materials have been ordered or work has begun may result in charges for materials already purchased and any labor performed up to the point of cancellation.
We reserve the right to reschedule or cancel work due to unsafe conditions, including severe weather, without liability to you.
Payment terms are specified in the written estimate or contract for each project. A deposit may be required before work begins, particularly for projects requiring material orders. Final payment is due upon completion of the work unless otherwise agreed in writing.
Accepted payment methods will be communicated at the time of estimate. Late payments may be subject to a finance charge of up to 1.5% per month on the outstanding balance, or the maximum rate permitted under Texas law, whichever is lower.
If a payment dispute arises, please contact us promptly so we can work toward a resolution before any collection process begins.
Before work begins, you are responsible for:
Delays or additional costs resulting from inaccurate property information, undisclosed underground features, or inaccessible work areas are the responsibility of the customer.
Where required, TX Nacogdoches Fence will apply for necessary building permits as part of the project. Permit fees, if not included in the written estimate, will be passed through to the customer at cost. Work will not commence until all required permits are obtained. If permitting is delayed for reasons outside our control, the project start date will be adjusted accordingly.
We stand behind our workmanship. If a defect in installation is identified within 1 year of project completion, we will return to correct the issue at no charge, provided the defect is the result of our work and not due to customer modifications, third-party interference, acts of nature, or normal wear and tear.
Materials are subject to the warranties provided by the manufacturer. We will assist you in pursuing a manufacturer warranty claim where applicable, but we are not responsible for defects in materials that are covered separately by the manufacturer.
Except for the workmanship warranty described in Section 8, all services and materials are provided "as is" and without any other express or implied warranty. We make no warranty that the work will meet any particular standard or expectation not described in the written estimate.
Natural weathering, fading, and normal wear are not covered by the workmanship warranty. Wood materials in particular are subject to natural variation, movement, and weathering that are characteristic of the material and are not defects.
To the fullest extent permitted by law, TX Nacogdoches Fence's total liability for any claim arising from or related to our services shall not exceed the amount paid by you for the specific project giving rise to the claim.
We are not liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of use, loss of income, or damage to adjacent property arising from circumstances outside our control, including acts of nature, third-party actions, or pre-existing conditions at the property.

If mediation fails, disputes will be resolved through binding arbitration in Nacogdoches County, Texas, in accordance with the rules of a mutually agreed arbitration service.
These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action not resolved through the dispute process described above shall be brought in the state or federal courts located in Nacogdoches County, Texas.
